California Lemon Law: How San Diego Drivers Can Get a Refund or Replacement for a Defective Vehicle

SAN DIEGO, CALIFORNIA — August 10, 2026 — California consumers who own or lease vehicles that repeatedly return to the repair shop for warranty-covered problems may have rights to a refund, replacement, or other compensation under California's Lemon Law, according to Scott Law Group P.C., a San Diego-based litigation firm founded by attorney Christian Scott.

Under California's Lemon Law, certain qualifying new motor vehicles may benefit from a legal presumption that the manufacturer has been given a reasonable number of opportunities to repair the vehicle when specific conditions occur within the first 18 months after delivery or the first 18,000 miles on the odometer, whichever occurs first.

Subject to applicable statutory requirements, the presumption may arise when the same defect that is likely to cause death or serious bodily injury has been subject to repair at least twice, the same qualifying nonconformity has been subject to repair at least four times, or the vehicle has been out of service because of warranty repairs for a cumulative total of more than 30 calendar days.

Those thresholds are not the only circumstances in which a consumer may have a claim. A vehicle may still qualify for relief outside the 18-month or 18,000-mile presumption period when a manufacturer or its authorized repair facility is unable to repair a warranty-covered defect after a reasonable number of attempts.

"For years, I represented automotive manufacturers, defending them against lemon law claims across 14 western states," said Christian Scott, founder of Scott Law Group P.C. "That experience showed me exactly how manufacturers build their defense, and I use it now to build stronger cases for consumers."

Scott Law Group represents California consumers in disputes involving defective vehicles, manufacturer warranties, and related consumer protection matters, and handles its own litigation when cases proceed beyond initial negotiations. The firm's practice includes matters involving new, used, and leased vehicles, including cars, trucks, motorcycles, recreational vehicles, and motor homes. The legal protections and remedies available can vary depending on the type of vehicle, warranty coverage, purchase or lease history, and circumstances of the individual claim.

California's Song-Beverly Consumer Warranty Act also includes protections involving attorney's fees and litigation costs. When a consumer prevails in a qualifying action, California law allows the consumer to recover attorney's fees and costs reasonably incurred in pursuing the case. Scott Law Group provides free case evaluations and represents clients throughout California in both English and Spanish.

"Consumers shouldn't accept a 'no problem found' write-up or an endless string of repair visits as the end of the story," Scott added. "If a defect hasn't been fixed after a reasonable number of attempts, it's worth exploring your legal rights."

Consumers experiencing repeated repairs, recurring warning lights, electrical problems, transmission issues, engine defects, safety concerns, or extended periods without their vehicle are encouraged to retain copies of repair orders, invoices, warranty documents, dealership communications, and records showing how long the vehicle remained out of service.

Consumers who believe their vehicle may qualify can request a free case evaluation by calling (619) 345-5599 or visiting lemonlawattorneysandiego.com/free-case-review.
